Premises Liability

Through no fault of our own, we may trip and fall or otherwise get injured while on another person or business' property.  This usually occurs due to the other person's failure to maintain their property and either create or fail to fix defective conditions. If they fail to do so and you or someone you know is seriously injured, the Company and/or property owner may be considered negligent and you may be entitled to money compensation for your injuries, and the pain and suffering caused by these injuries.

In fact, you likely have a case if you slip or trip and fall at restaurants, bars, apartments, commercial and residential buildings, shopping malls, supermarkets, parks, airports, hospitals, or any property where the owner has not maintained the proper safety precautions.  This also applies to situations where you were injured because of an owner's failure to provide proper security procedures (bar fight, forced entry leading to an assault,) and/or in circumstances where an apartment building owner failed to remedy a dangerous condition (lead paint, mold.)  If you are injured in a public place, New York State or New York City may be the property owner (subway staircases and platforms, etc.)  If you are injured on City property, it is very important that you contact our or another legal firm immediately, as time is of the essence when bringing a lawsuit against the City of New York.  If deadlines are missed, you may be precluded permanently from suing the City for this particular incident.

In order to establish a premises liability case in New York, such as the ones mentioned above, in most cases, it must be demonstrated that the property owner had prior knowledge or should have known about the defect and that such condition was not corrected before the accident occurred or because they were notified of the defective condition prior to the accident. Common premises liability cases in New York include, but are in no way limited to: Slip and fall or trip and fall accidents Defective conditions in stores Broken sidewalks Broken or loose steps Elevator/escalator accidents Assaults caused by improper locks and/or security procedures (including bar fights) Icy sidewalks or walkways Spills and wet floors Dim lighting in a dark area resulting in a dangerous environment Lead poisoning Mold poisoning Victims of premises liabilities are often permanently injured and need medical attention including surgery and physical therapy.

If you have been injured on a Company or person’s property, you may be entitled to be compensated for your medical bills, lost wages, future lost wages, and pain and suffering.
